Terms And conditions
1. Definitions
1.1 “Company” means JAMES NATHANIAL SCOTT HITA T/A The Creative Consulting Group and Creative Screen Prints.
1.2 “Client” means the person or entity placing the order.
1.3 “Goods” means garments, apparel, promotional items or printed materials supplied.
1.4 “Services” means embroidery, screen printing, transfers, design, digitising and related production services.
2. Acceptance
2.1 A quotation issued by the Company is valid for 14 days unless stated otherwise.
2.2 An order is accepted when the Client confirms acceptance in writing (email or signed quote)
2.3 Upon acceptance, a binding contract is formed.
2.4 By accepting a quote, the Client agrees to these Terms & Conditions.
3. Pricing
3.1 All prices are in AUD and exclusive of GST unless stated otherwise.
3.2 Prices are based on quantities quoted. Changes to quantities may alter unit pricing.
3.3 Additional charges apply for:
Artwork preparation
Digitising
Colour separations
Rush orders
Special garment sourcing
4. Deposits & Payment
4.1 A 50% deposit is required before production commences unless otherwise agreed.
4.2 The balance is payable prior to dispatch or collection unless credit terms are approved.
4.3 Production will not commence until the deposit has been received. The Company reserves the right to cancel or suspend the order if the deposit is not paid within a reasonable time.
4.4 Overdue accounts may incur interest at 2% per month.
5. Artwork & Proof Approval
5.1 The Client is responsible for providing correct artwork.
5.2 Where your invoice contains garment colour/sizes, decoration type, logo descriptions, logo position, and other information regarding your decorations, approving or paying the invoice will act as approval for the job.
5.3 By approving a proof or paying an invoice, the Client confirms:
Artwork content is correct
Spelling is correct
Placement and sizing are correct
Colours are acceptable
5.4 The Company cannot be held liable for errors once artwork has been approved.
6. Colour & Production Variations
6.1 Slight variations in colour, size, positioning or finish may occur.
6.2 Pantone matching is approximate unless explicitly quoted as exact match.
6.3 The Company reserves the right to supply quantities within +/- 5% of the order.
6.4 The Client will be invoiced for the actual quantity supplied. Where the quantity supplied is less than ordered, the Client will not be charged for the shortfall.
7. Garment Supply
7.1 Garment availability is subject to supplier stock.
7.2 If a garment becomes unavailable, a comparable alternative may be offered.
7.3 The Company is not responsible for manufacturer defects outside reasonable inspection.
8. Turnaround Times
8.1 Turnaround times are estimates only.
8.2 Production time commences after:
Deposit payment
Artwork approval
Garments received (if applicable)
All necessary information is received from The Client.
8.3 The Company is not liable for delays caused by:
Supplier delays
Client delays in approvals
Courier disruptions
Events outside reasonable control
9. Intellectual Property
9.1 The Client warrants they hold rights to all artwork supplied.
9.2 The Company is indemnified against claims arising from IP infringement.
9.3 Digitised embroidery files remain the property of the Company unless otherwise agreed in writing.
10. Storage
10.1 Completed goods not collected within 14 days may incur storage fees.
10.2 The Company may dispose of uncollected goods after reasonable notice.
11. Cancellations
11.1 Orders cancelled after production has commenced are liable for all costs incurred to date.
11.2 Custom goods cannot be returned for change-of-mind.
12. Returns & Claims
12.1 Claims must be made within 7 days of receipt.
12.2 The Company’s liability is limited to repair, replacement or refund at its discretion.
13. Title & Risk
13.1 Ownership of goods remains with the Company until payment in full is received.
13.2 Risk passes to the Client upon collection or dispatch.
13.3 The Company is not liable for courier delays or damage once goods have been dispatched.
14. Limitation of Liability
14.1 The Company’s liability is limited to the value of the goods supplied.
14.2 The Company is not liable for consequential loss, loss of profit or indirect damages.
15. Force Majeure
15.1 The Company is not liable for failure or delay due to events beyond reasonable control.
16. Governing Law
16.1 These Terms are governed by the laws of Queensland, Australia.
